SYNOPSIS OF THE TALK
There is an apparent contradiction between the principle that an Arbitrator or Judge cannot posit a theory of his own, and that where he cannot abdicate the decision making to an expert in matters involving expert evidence. This talk will attempt to identify the boundaries beyond which an arbitrator or judge should not cross.

ABOUT THE SPEAKER
Rajendra Navaratnam obtained his first degree in Electrical Engineering and started his career as an Electrical Engineer in the Power industry for about 10 years before he retrained in law and started his legal career with Azman Davidson & Co in 1988.

He became a Partner of Azman Davidson & Co in 1993, where he practises at present.
Rajendra practices primarily in technology related law, in the areas of construction, insurance and intellectual property in both litigation and arbitration.

He appears as counsel in the Court of Appeal and the Federal Court. He acts for and advises employers, contractors and sub-contractors on construction issues, and mainly Insurers on insurance claims with technical content.

He also sits as Arbitrator in construction and other disputes in both international and domestic arbitrations, and is on the panel of arbitral institutions such as the KLRCA, IEM, ICC and PORAM. He is a Fellow of the Chartered Institute of Arbitrators, England and is a Chartered Arbitrator.
